UPON hearing counsel the Court made the following O R D E R This appeal is dismissed in terms of the signed order. (Sukhbir Paul Kaur) (Renuka Sadana) Court Master Court Master (Signed Order is placed on the file) IN THE SUPREME COURT OF INDIA CIVIL APPELLATE JURISDICTION CIVIL APPEAL NO.7266 OF 2004 STATE OF BIHAR & ORS. Appellant(s) Versus JAYAKANT MISHRA & ORS. Respondent(s) O R D E R We have heard learned counsel for the parties. We do not find any infirmity whatsoever in the impugned judgment requiring our interference. Be that as it may that 'Maithili' language by virtue of the Constitution (Ninety-Second Amendment) Act, 2003 has been included as Item 10 in the 8 th Schedule of the Constitution. In such view of the matter, the issue raised in this appeal has become academic. In fact, it is brought to our notice that the State of Bihar has withdrawn Civil Appeal Nos. 2203- 2208 of 2001 in which similar issue had arisen for consideration and the appeals were accordingly, dismissed as withdrawn. We find no merit in this appeal and the same is accordingly, dismissed. ....................J. (B.SUDERSHAN REDDY) ....................J. (SURINDER SINGH NIJJAR) New Delhi, September 30, 2010
