Respondents O R D E R This petition is directed against the Order dated 1 8 th July, 2 0 0 7 passed by the High Court of Judicature at Allahabad in Civil Misc. Writ Petition No.3 1 8 6 4 of 2 0 0 7 . The main grievance of the petitioner is regarding appointment of respondent no.5, namely, Shri S.C. Ina md a r, as the sole arbitrator. According to the petitioner, the appointment of the arbitrator was done without consulting the petitioner herein and since the rules and regulations of the disputes' resolution policy of respondent no.2 were found to be inconsistent with the Indian Arbitration & Conciliation Act 2 1 9 9 6 , therefore, the petitioner filed the writ petition before the High Court of Allahabad, which was dismissed. On 1 4 th September, 2 0 0 7 when the matter was taken up for prelimin a ry hearing by this Court, the learned counsel appearing for respondent no.4 submitted that the final award has already been passed by the arbitrator and he sought for two weeks' time to file supplementa ry affidavit. In the supplementa ry affidavit dated 2 5 th September, 2 0 0 7 it is mentioned that on 2 0 th July, 2 0 0 7 respondent no.5 has given his award and the petitioner has also annexed a copy of the award along with the supplementa ry affidavit. Mr. Ranjit Ku m a r , Sr. Advocate appearing for the petitioner submitted that since the arbitrator has filed his award, the petitioner now may be permitted to challenge the same before the appropriate forum within a period of two weeks. The request of the petitioner seems to be reason able. Since the parties were prosecuting their remedy before this Court and the petitioner could not challenge the award earlier therefore, we grant two weeks' time to the petitioner to 3 challenge the award of the arbitrator before the appropriate forum. No further directions are necessa ry in this petition. The petition is accordingly disposed of. We direct the parties to bear their own costs. ..................... J.
